Terms of Use

A clear pact between us.

These terms cover the WakePact app and website, including safety, subscriptions, acceptable use, and service limitations.

Important safety note

WakePact is a wellness and habit-building tool, not medical care or an emergency service. Use physical challenges only when they are safe and appropriate for you.

1. Agreement to these terms

These Terms of Use (“Terms”) govern your use of the WakePact mobile application, website, and related services (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use WakePact.

When you obtain WakePact through Apple, Apple's Standard Licensed Application End User License Agreement also applies unless a valid custom license agreement is provided through the App Store. If these Terms conflict with mandatory platform terms, the mandatory platform terms control.

2. Eligibility

You must be legally capable of agreeing to these Terms. If you are under the age of majority where you live, a parent or guardian must review and agree to these Terms on your behalf. WakePact is not directed to children under 13.

3. What WakePact provides

WakePact provides alarms, optional movement challenges, progress records, wellness summaries, subscription features, and related tools intended to support a morning routine. Features may depend on device compatibility, iOS permissions, network availability, subscription status, and third-party services.

4. Alarm reliability

WakePact is designed to deliver alarms through supported Apple system frameworks, but no software alarm can be guaranteed in every circumstance. Delivery may be affected by device power, volume and focus settings, permissions, operating-system behavior, hardware failure, or other conditions outside our control. Do not rely on WakePact as your only alarm for emergencies, medical care, safety-critical duties, travel, examinations, employment obligations, or any event where a missed alert could cause serious harm or loss. Use an independent backup when the consequence of missing an alarm is significant.

5. Physical challenge safety

You are responsible for deciding whether push-ups or any movement challenge is appropriate for your health, ability, surroundings, and current condition. Use a clear, stable area and secure your device before beginning. Stop immediately if you feel pain, dizziness, shortness of breath beyond normal exertion, or other concerning symptoms. Seek professional medical advice if you are unsure whether an activity is safe for you. WakePact does not diagnose, treat, prevent, or cure any medical condition.

6. Permissions and device access

Some features require permissions such as alarms, notifications, camera, or HealthKit. You may deny or revoke permissions in iPhone Settings, but related features may then be unavailable. You must not use camera-based features in a way that violates another person's privacy.

7. Subscriptions and purchases

Some features require WakePact Pro. Purchases are processed by Apple through the App Store and your Apple Account. Prices, billing periods, trial eligibility, and included features are shown before purchase. Unless otherwise stated by Apple, auto-renewable subscriptions renew automatically until canceled. Your Apple Account may be charged within 24 hours before the end of the current period.

You can manage or cancel a subscription in your Apple Account subscription settings. Deleting WakePact does not cancel a subscription. Trial eligibility is determined by Apple, and unused trial time may be forfeited where permitted. Refund requests are handled by Apple under its policies. Use Restore Purchases in WakePact when you need to refresh an eligible purchase.

8. Acceptable use

You may use WakePact for personal, lawful purposes. You may not:

  • Interfere with, damage, overload, or bypass the Service or its security measures.
  • Use the Service to violate law, another person's rights, or platform rules.
  • Reverse engineer, decompile, or extract source code except where applicable law expressly permits it.
  • Use automated means to scrape, probe, or access the Service without permission.
  • Misrepresent your relationship with WakePact or use WakePact branding without authorization.

9. Third-party services

WakePact works with Apple frameworks and services and may use third-party providers for advertising, paywall presentation, hosting, and optional connected features. Their products and policies may change independently. We are not responsible for third-party services, but we choose integrations intended to support the Service and describe relevant data practices in our Privacy Policy.

10. Intellectual property

WakePact, its software, visual design, text, graphics, trademarks, and other original content are owned by WakePact or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, you receive a limited, personal, revocable, non-exclusive, non-transferable license to use the app on Apple devices you own or control as allowed by applicable App Store terms.

11. Feedback

If you send ideas or suggestions, you grant us permission to use them without restriction or compensation, provided we do not publicly identify you without permission.

12. Changes, suspension, and termination

We may add, change, suspend, or discontinue features to improve WakePact, respond to security or legal requirements, or address third-party changes. We may restrict access when reasonably necessary to protect the Service or enforce these Terms. You may stop using WakePact at any time. Sections that by their nature should survive termination will continue to apply.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

14. Limitation of liability

To the fullest extent permitted by law, WakePact and its developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, opportunities, or goodwill arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid for WakePact in the twelve months before the claim or US$50. These limits do not apply where prohibited by law.

15. Changes to these terms

We may update these Terms from time to time. We will post the revised version here and update the date above. If a change is material, we may provide additional notice. Continuing to use the Service after updated Terms take effect means you accept them, to the extent permitted by law.
